Eligibility for Review
If a visa has been refused or cancelled, you may have a right to independent merits review at the Administrative Review Tribunal (ART) — the body that replaced the AAT in October 2024. You may be eligible to seek review if you:
- Received a reviewable decision — many visa refusals and cancellations carry review rights.
- Apply within the strict time limit — review deadlines are short (often 21 or 28 days) and generally cannot be extended.
- Are an eligible applicant — the visa applicant, visa holder, sponsor or nominator, depending on the decision.
